The legal mechanism

How the Act does its work

The Act is the gateway; the detailed rights sit inside each agreement and interact with the wider social-security law.

1

Find the schedule

Start with the agreement country and the scheduled agreement that applies. Current agreement status must be checked against the official DSS and legislation sources.

2

Read its scope

Check the agreement's covered payments, people, territories, authorities and any contribution or residence rules.

3

Apply the agreement

A scheduled agreement can modify how Australian social-security law applies to the matters covered by that agreement.

4

Test portability and rate

Then test whether the payment can be claimed or paid outside Australia and how any residence or proportional-rate rules operate.

2017 residence factor

See the historical proportional-rate logic

Historical 2017 illustration only. The agreement and current law determine the actual qualification and rate.

residence factor = min(months ÷ 420, 1)

Historical residence factor 50.0% Illustrative proportional amount $12,000.00 a year

Plain-English glossary

Terms that unlock the international rules

Scheduled agreement

A bilateral Australian social-security or superannuation reciprocity agreement whose text is scheduled to the Social Security (International Agreements) Act 1999.

Australian working-life residence

A residence concept used in parts of Australia's international social-security framework. The applicable agreement and current law control the calculation.

Totalisation

An agreement technique that may combine qualifying periods in two countries to help satisfy a minimum residence or contribution requirement.

Portability

Whether, and for how long, a payment may continue while the person is outside the country that pays it.

Residence factor

A proportional-rate concept used by some historical Australian agreement rules. The illustration in Compass is explicitly the 2017 version, not a current entitlement calculator.
